 PART I PRELIMINARY
  
  hort title
  Ordinance may be cited as the Consumer Council Ordinance.
  nterpretation
  his Ordinance, unless the context otherwise requires--
  ncil" means the Consumer Council incorporated by section 3 (1);
  ancial year" means each period of 12 months ending with 31 March;
  ber" means a member of the Council.
 PART II INCORPORATION AND POWERS
  
  ncorporation of Consumer Council
  The Consumer Council existing at the commencement of this
Ordinance is
  by created a body corporate consisting of the persons who from
time to
  hold office as members of the Council.
  The Council shall have perpetual succession and a common 
seal and
  l be capable of suing and being sued and of doing and suffering 
all
  other acts and things as bodies corporate may lawfully do and
suffer.
  The Council shall continue to be known in the Chinese language
as.
  unctions of Council
  The functions of the Council are to protect and promote the 
interests
  onsumers of goods and services and purchasers, mortgagors and 
lessees
  mmovable property by--
  collecting, receiving and disseminating
  rmation concerning goods, services and immovable property;
  receiving and examining complaints by and giving advice to 
consumers
  oods and services and purchasers, mortgagors and lessees of 
immovable
  erty;
  taking such action as it thinks justified by information 
in its
  ession, including tendering advice to the Government or to any 
public
  cer;
  encouraging business and professional associations to
  blish codes of practice to regulate the activities of their
members;
  undertaking such other functions as the Council may adopt 
with the
  r approval of the Governor in Council.
  The Governor may be notice in writing to the Council 
declare any
  s, services or immovable property or class of goods, 
services or
  vable property to be outside the scope of the Council's 
functions
  r subsection (1).
  In subsection (1) and in section 5 (2) (c) "goods and services" 
does
  include goods and services which are--
  supplied by--
  the Government, the Urban Council or the Regional Council; or

  a body mentioned in the Schedule; or
  made the subject of a declaration under subsection (2).
  The Governor in Council may, by order published in the Gazette, 
amend
  Schedule. (Amended 5 of 1992 s. 2)

  The Council may do such things as are reasonably necessary to 
enable
  o carry out its functions.
  Without restricting the generality of subsection (1), the Council 
may
  arrying out its functions--
  acquire, hold and dispose of all kinds of property 
movable and
  vable and in any manner which it thinks fit;
  enter into any contract;
  undertake the testing and examination of goods and 
services and
  ection of immovable property; (Amended 5 of 1992s. 3)
  produce or distribute, by way of sale or otherwise, any 
publication
  h is of interest to consumers;
  do any thing which it may do under this ordinance in 
association or
  peration with any other person or sponsor any other person to do 
that
  g;
  charge for the use of any facility or service provided by the
Council;
  with the prior approval of the Governor, become a member 
of or
  liate to any international body concerned with consumer matters.
  
  embership of Council
  The Council shall consist of the following members--
  a Chairman who shall be appointed by the Governor for a 
term not
  eding 2 years;
  a Vice-Chairman who shall be appointed by the Governor for a term 
not
  eding 2 years; and (Replaced 28 of 1985 s. 2)
  not more than 20 other persons each of whom shall be appointed
by the
  rnor for a term not exceeding 2 years. (Replaced 28 of 1989 s.
2)
  The Chairman, Vice-Chairman and any other member 
appointed under
  ection (1) (c) may be reappointed upon expiry of their 
respective
  s of office. (Amended 28 of 1985 s. 2)
  The Chairman, Vice-Chairman and any other member 
appointed under
  ection (1) (c) may at any time-- (Amended 28 of 1985 s. 2)
  resign his office by notice to the Governor; or
  be removed therefrom by the Governor for permanent incapacity or
other
  icient cause, and upon such resignation or removal the term for 
which
  as appointed shall be deemed to have expired.
  Where the Chairman, Vice-Chairman or any other member appointed 
under
  ection (1) (c) is precluded by temporary incapacity or other 
cause
  exercising his functions as such for any period the 
Governor may
  int another person to act in place of the Chairman Vice-
Chairman or
  r member during such period with all such rights, powers, 
duties or
  ilities as if he had been appointed under subsection (1). (Amended

  Where any question arises under subsection (3) or (4) as to 
whether
  incapacity or cause exists or whether any incapacity is 
temporary or
  anent or any cause sufficient, the decision of the Governor 
thereon
  l be final.
  eetings of Council
  Meetings of the Council shall be held at such times and places
as the
  cil, the Chairman or in his absence, the Vice-Chairman may from 
time
  ime appoint.
  The following procedural provisions shall apply to
  y meeting of the Council and subject thereto the Council may 
regulate
  own procedure--
  at meetings of the Council 11 members shall form a quorum;

  the Chairman or in his absence, the Vice-Chairman shall preside

  are absent or disqualified under section 9 (c), the members

  every question shall be determined by a majority of votes

  in the event of an equality of votes the member presiding shall
have a
  ing vote in addition to his ordinary vote.

  ommittees
  The Council may appoint committees and may delegate to 
them the
  cise and performance of any of its powers and functions except 
this
  r of delegation.
  Persons who are not members of the Council are
  ible for appointment to committees.
  Subject to the terms of any delegation by the 
Council, every
  ittee--
  may exercise and perform the delegated powers and functions
  the same effect as if it were the Council itself;
  shall be presumed to be acting in accordance with the terms of 
the
  gation in the absence of proof to the contrary;
  may regulate its own procedure.
  isclosure of member's interest
  member of the Council, or of any committee of the Council, 
has a
  ct or indirect commercial interest in any matter under discussion
at a
  ing of the Council or of the committee, being an interest greater
than
  which he has as a member of the general public, the 
following
  isions shall apply--
  he shall disclose the nature of his interest at the meeting;
  the disclosure shall be recorded in the minutes;
  where the disclosure is made by the member presiding, he shall 
vacate
  chair during the discussion;
  the member (including one who has vacated the chair under
paragraph
  shall, if so required by the member presiding, withdraw 
from the
  ing during the discussion and shall not in any case, 
except as
  rwise determined by the member presiding, vote on any 
resolution
  erning the matter or be counted for the purpose of establishing 
the
  tence of a quorum.
  Appointment of staff and advisers
  Subject to subsection (4), the Council shall appoint a person to 
hold
  office of Chief Executive. (Amended 28 of 1985 s. 4)
  The Council may appoint such other employees as it thinks 
fit and
  ect to subsection (4), determine all matters relating 
to their
  neratior and terms and conditions of appointment or employment.
  The Council may engage the services of technical and 
professional
  sers in such manner and on such terms and conditions as it thinks
fit.
  The Council shall obtain the prior approval of the Governor to--
  any appointment proposed to be made under subsection (1) and the
terms
  conditions thereof;
  the suspension or dismissal of the Chief Executive;
  the salary or salary scale (including allowances and other 
pecuniary
  fits) and conditions of employment applicable to the Chief 
Executive
  every other employee or class employee, and any variation
thereof.

  No person shall be employed by the Council otherwise than on the
salar
  alary scale or on the conditions of employment applicable to that
pers
  oved by the Governor under subsection (4).
  
  Documents of Council
  The Council may make and execute all such documents as may 
expedient
  or conducive to the exercise and performance of its power 
functions
  duties.
  The fixing of the seal of the Council to any document
  l--
  be authorized by resolution of the Council; and
  be authenticated by the signatures of any 2 members 
authorize by
  lution of the Council, either generally or specially, to ao for 
that
  ose.
  Any document purporting to be duly executed under the seal 
of the
  cil shall, unless the contrary is proved, be considered to be 
duly
  uted.
  Any contract or instrument which if entered into or executed 
by a
  on not being a body corporate would not be required to be in the 
form
  deed may be entered into or executed on behalf of the Council by 
any
  on generally or specially authorized by the Council for that 
purpose.
 PART III FINANCIAL
  
  Resources of Council
  The Governor may, out of money appropriated for the purpose 
by the
  slative Council, authorize payment to the Consumer Council 
of such
  nts as he thinks fit.
  The resources of the Council shall consist
  
  all money received by the Council pursuant to subsection (1);
  money paid to the Council by way of donations, fees, 
subscriptions,
  and interest;
  all other money and property, including accumulations of 
income,
  ived by the Council for its purposes.
  Borrowing powers
  Council may, with the approval of the Financial Secretary, 
borrow or
  rwise raise money and charge all or any part of its 
property as
  rity therefor.
  Investment of funds
  money of the Council that is not immediately required 
shall be
  sted--
  on fixed deposit in any bank or savings bank approved by the
  ncial Secretary, either generally or in any particular case, for 
the
  ose; or
  in such other forms of investment as the Financial 
Secretary may
  ove.
  Estimates
  Council shall in each financial year adopt estimates of 
income and
  nditure for the ensuing financial year and, before a date 
to be
  inted by the Financial Secretary, send them to the Governor for 
his
  oval together with a programme of its proposed activities 
for the
  ing financial year.
  
  Accounts, audit and annual report
  The Council shall keep proper accounts and proper records in 
relation
  eto and shall within 3 months after the expiry of a financial year,
or
  further period as the Financial Secretary may allow, 
prepare a
  ement of the accounts of the Council, which statement shall
include an
  me and expenditure account and a balance sheet.
  The Council
  l, subject to subsection (3), appoint an auditor, who 
shall be
  tled to have access at any time to all books of account, vouchers 
and
  r financial records of the Council and to require such information
and
  anations relating thereto as he thinks fit.
  The Council shall obtain the prior approval of the Financial
Secretary
  ny appointment proposed to be made under subsection (2).
  The auditor shall, as soon as is practicable, audit the 
accounts
  ired by subsection (1) and shall submit a report thereon 
to the
  cil.
  The Council shall within 3 months after the receipt by it 
of the
  tor's report in respect of its accounts for a financial 
year, or
  in such further period as the Financial Secretary may allow,
furnish--
  a report on the affairs of the Council for that year;
  a copy of its accounts therefor; and
  the auditor's report on the accounts, to the Governor who shall 
cause
  same to be tabled in the Legislative Council.
 PART IV GENERAL
  
  Council not servant or agent of Crown
  Council is not a servant or agent of the Crown and does not enjoy 
any
  us, immunity or privilege of the Crown.
  Governor may give directions
  The Governor may, if he considers that the public 
interest so
  ires, give to the Council such directions as he thinks 
fit with
  ect to the exercise and performance by the Council of its 
powers,
  tions and duties under this Ordinance, either generally or 
in any
  icular case.
  The Council shall comply with any direction given to 
it under
  ection (1).
  Protection of members of Council and committees
  No member or employee of the Council or of any committee 
of the
  cil shall be personally liable for any act done or default made--
  by the Council; or
  by any committee of the Council, acting in good faith in the course
of
  operations of the Council or of the committee.
  The protection hereby conferred on members and employees 
of the
  cil or of a committee in respect of any act or default shall not 
in
  way affect any liability of the Council for that act or default.
  
  Prohibition of exploitation of the Council's name for 
advertisement
  oses
  No person shall, with a view to promoting or disparaging any
  s, services or immovable property or promoting the image 
of any
  on, publish or cause to be published any advertisement which 
either
  essly or by implication makes reference to--
  the Council;
  any committee, member, agent or employee of the Council;
  the Council's publication or finding of tests or surveys
conducted by
  n behalf of the Council; or
  any other information published by the Council, without 
written
  ent of the Council.
  Any person who contravenes subsection (1) commits an offence 
and is
  le to a fine of $ 100,000.
  For the purpose of subsection (1) "advertisement" may be 
constituted
  ny words, whether written or spoken, or any picture, drawing, 
visual
  e, figure or article--
  appearing in any publication; or
  brought to the notice of the public or any section of the public 
in
  other way. (Replaced 5 of 1992 s. 5)
  Transitional provisions
  All property of whatever kind and whether movable or immovable 
vested
  r belonging to the Consumer Council existing at the 
commencement of
  Ordinance shall as from that date vest in or belong to that 
Council
  ts corporate capacity without any further assurance.
  All obligations and liabilities of the said Consumer Council 
are as
  the commencement of this Ordinance the obligations and
liabilities of
  Council in its corporate capacity.
  Where anything has been commenced by or under the authority 
of the
  Consumer Council before the commencement of this Ordinance such
thing
  be carried on any completed by the Council in its corporate
capacity.
  Every person who immediately before the commencement of this
Ordinance
  s an appointment as Chairman, Executive Director or a member of 
the
  Consumer Council is, as from such commencement but subject to 
the
  s of his appointment, the Chairman, Executive Director, or a
member of
  Council, as the case may be, for the purposes of this Ordinance.
  Notwithstanding the definition of "financial year" in section 
2 the
  od between the commencement of this Ordinance and 31 March 1978 
shall
  eemed to be a financial year.
  No stamp duty shall be payable in respect of any transfer of 
property
  r this section.

安徽省城市房屋拆迁管理实施细则

  第一章 总则

第一条 根据国务院《城市房屋拆迁管理条例》(以下简称《条例》第四十二条的规定,结合本省实际,制定本细则。

  第二条 凡在本省城市规划区内国有土地上,因建设需要拆迁房屋及其附属物的,必须遵守《条例》和本细则。

  第三条 省城乡建设环境保护厅主管全省城市房屋拆迁工作。

  地、市、县房地产行政主管部门(以下称房屋拆迁主管部门)主管本行政区域内的城市房屋拆迁工作。

  第四条 各行署和市、县人民政府应加强对城市房屋拆迁工作的领导。城市规划、计划、公安、土地、工商行政管理等部门和街道办事处应按照各自的职责,配合房屋拆迁主管部门做好房屋拆迁管理工作。

  第二章 房屋拆迁一般规定

第五条 单位或者个人需要拆迁房屋;必须持下列文件向市、县房屋拆迁主管部门申请:

  (一)建设项目的批准文件;

  (二)市、县城市规划部门核发的建设用地规划许可证;

  (三)拆迁计划和拆迁方案。

  第六条 房屋拆迁涉及土地使用权变更的,拆迁人应按规定到土地管理部门申请用地,办理土地使用权变更登记手续。

  第七条 房屋拆迁主管部门接到拆迁申请后,必须在十五日内作出审批决定。准许拆迁的,发给房屋拆迁许可证。房屋拆迁许可证文本,由省城乡建设环境保护厅统一制发。

  第八条 房屋拆迁许可证发放后,房屋拆迁主管部门应及时做好下列工作:

  (一)将拆迁人、拆迁范围、搬迁期限等以房屋拆迁公告等形式公布;

  (二)通知有关部门暂停办理拆迁范围内房屋权属变更登记和抵押;

  (三)通知公安部门暂停办理拆迁范围内居民的入户和分户;

  (四)通知工商行政管理部门暂停核发拆迁范围内的营业执照;

  (五)及时向被拆迁人做好宣传解释工作。

  除本细则第九条规定外,有关部门接到房屋拆迁主管部门的通知后办理的各项手续,均不得作为拆迁补偿安置的依据。

  第九条 拆迁范围公布以后,因出生、毕业、婚嫁、军人复转退、刑满释放、劳教期满等原因,确需迁入拆迁范围内或分户的,必须经被拆除房屋所在地县级以上人民政府批准。公安部门应将入户、分户情况及时通知拆迁人和房屋拆迁主管部门。

  第十条 房屋拆迁公告公布后,拆迁人与被拆迁人应当根据市、县人民政府规定的补偿安置标准,签订补偿安置书面协议。协议应当包括以下内容:

  (一)拆迁补偿形式和补偿金额;

  (二)安置用房面积和安置地点;

  (三)搬迁过渡方式和过渡期限;

  (四)违约责任;

  (五)双方认为需要订立的其他条款。

  第十一条 各市、县人民政府可以根据当地实际情况,制定本地区拆迁房屋补偿、安置的具体标准和临时安置补助费标准、搬家补助费标准。

  第十二条 在公布的拆迁期限届满前十日,拆迁人与被拆迁人仍未达成补偿、安置协议的,当事人可向批准拆迁的房屋拆迁主管部门申请裁决。房屋拆迁主管部门应在公布的拆迁期限内作出裁决。

  第十三条 房屋拆迁主管部门进行裁决时,必须制作裁决书。裁决书的内容应包括:

  (一)当事人的姓名(名称)、住(地)址;

  (二)提请裁决的事实;

  (三)裁决的结果及法律依据;

  (四)当事人对裁决不服时的权利。

  裁决书式样由省建设厅统一规定。

  第十四条 由当地政府统一组织拆迁的,应进行统一规划、统一拆迁、统一补偿安置。拆迁事务由取得《房屋拆迁资格证书》的单位承担。拆迁人委托拆迁的,被委托拆迁人应当是取得《房屋拆迁资格证书》的单位。被委托拆迁人接受委托拆迁后,应当与拆迁人签订委托拆迁合同。

  第十五条 在房屋拆迁公告或裁决规定的拆迁期限内,被拆迁人无正当理由拒绝拆迁的,由批准拆迁的房屋拆迁主管部门报请同级人民政府责令限期拆迁,逾期不拆迁的,由县级以上人民政府责成有关部门强制拆迁,或由房屋拆迁主管部门申请人民法院强制拆迁。有关部门实施强制拆迁时,执行人员应制作现场记录,记明强制执行过程和搬迁的财物。现场记录由执行人、被执行人和被拆除房屋所在地街道办事处派出的见证人签名。被执行人拒绝签名的,应在现场记录中注明。

  第十六条 拆迁完成后,拆迁人须持有关资料到房屋拆迁主管部门办理房屋拆迁验收手续,验收合格后,方可到规划部门领取建设工程规划许可证。

  第十七条 房屋拆迁后,原房屋的所有权人应到当地房地产管理部门办理房屋所有权注销手续。新建房屋的所有权人,应及时到房地产管理部门办理所有权登记手续。

  第十八条 下列资料由房屋拆迁主管部门收集归档:

  (一)房屋拆迁、建设的有关批准文件;

  (二)拆迁计划和拆迁安置方案;

  (三)拆迁范围内房屋结构、产权及人口居住情况资料;

  (四)补偿安置协议书副本和委托拆迁合同副本;

  (五)拆迁过程中的检查处理文件;

  (六)与拆迁有关的建设项目竣工文件。

  第三章 拆迁补偿

第十九条 拆迁补偿实行产权调换、作价补偿,或者产权调换和作价补偿相结合的形式。

  第二十条 产权调换按偿还房屋和被拆除房屋建筑面积一比一的比例计算。以新建楼房补偿平房的,补偿的面积可以适当增加,但增加部分不得超过原房屋建筑面积的百分之十。房屋建筑面积以有效产权证明记载的数据为准。

  第二十一条 作价补偿金额按照被拆除房屋的重置价格结合成新结算。

  第二十二条 以产权调换形式偿还的私有和单位自管住宅房屋,偿还建筑面积与原建筑面积相等的部分,按重置价格结算结构差价;偿还建筑面积超过原建筑面积的部分,在安置标准内的,按重置价格结算,超过安置标准的,按商品房价格结算;偿还建筑面积不足原建筑面积的部分,按重置价格结合成新结算。

  第二十三条 拆除房管部门直管住宅房,一律实行产权调换。偿还房屋提高结构质量增加的费用和在安置标准以内增加的面积,不另行补偿。

  第二十四条 拆除产权所有人不明的房屋,由房屋拆迁主管部门公告,并按本细则有关规定补偿。逾期无人请求产权的,偿还的房屋和补偿款,由房屋拆迁主管部门代管。

  第二十五条 拆除无《房屋所有权证》的房屋,不予补偿。

  第四章 拆迁安置

第二十六条 对被拆除房屋的使用人,应当根据城市规划对建设地区的要求和建设工程的性质,按照有利于实施城市规划和城市旧区改建的原则,实行原地或易地安置。拆除与人民生活密切相关的、具有区域功能的服务性、事业性单位的房屋,应统一规划,就地或就近安置。

  第二十七条 从区位好的地段迁入区位差的地段的,可适当增加安置面积,并免收增加面积的价款,增加的比例由市、县人民政府规定。

  第二十八条 设计安置用房时,应综合考虑需要安置的户数、户型、面积标准、使用功能等因素。

  第二十九条 下列被拆除房屋的使用人不予安置:

  (一)无房屋所有权证的房屋;

  (二)属于违章建筑的房屋;

  (三)无合法房屋租赁证件承租的房屋。

  第三十条 拆除住宅房屋,按照原使用面积安置。对按原使用面积安置确有困难的,可以在原使用面积的百分之十以内适当增加。

  第三十一条 被拆除房屋使用人自愿放弃或减少安置的,拆迁人应给予适当奖励。

  第三十二条 被拆除房屋使用人因拆迁而搬出的,由拆迁人一次性发给搬家补助费。因拆迁人的责任需再次搬迁的,追加相同标准的补助费。

  第三十三条 在规定的过渡期内,被拆除房屋使用人自行解决过渡房屋的,拆迁人应付给临时安置补助费。

  被拆除房屋使用人由所在单位解决过渡房屋的,临时安置补助费付给该单位。

  第三十四条 由拆迁人提供周转房,过渡期不超过十八个月的,不付给临时安置补助费;过渡期超过十八个月的,应按规定付给临时安置补助费;过渡期超过三十个月的,拆迁人必须采取安置措施。

  第三十五条 拆除生产、营业用房的,拆迁入应帮助其维持临时生产或经营。拆迁人确有困难的,由拆迁人按被拆迁单位职工的基本工资,付给职工生活补助费;私营企业、个体工商户按当地同类工种平均工资付给从业人员补助费。从业人数以《营业执照》记载为准。

  第五章 罚则

第三十六条 有下列行为之一的,由房屋拆迁主管部门予以警告、责令停止拆迁、限期纠正,并可对单位处一千元以上、一万元以下的罚款,对个人处一百元以上、一千元以下的罚款:

  (一)未取得房屋拆迁许可证,擅自拆迁的;

  (二)委托未取得《房屋拆迁资格证书》的单位拆迁的;

  (三)擅自提高或降低补偿安置标准,扩大或缩小补偿安置范围的。

  第三十七条 未按房屋拆迁许可证规定,擅自扩大或缩小拆迁范围的,由房屋拆迁主管部门予以警告、限期纠正,可并处五百元以上、一千元以下的罚款。

  第三十八条 拆迁人无正当理由超过规定拆迁期限或擅自延长过渡期限的,由房屋拆迁主管部门予以警告,并从超过或擅自延长的期限之日起,按月处以复建房屋建筑工程预算造价千分之一的罚款。

  第三十九条 被拆迁人违反拆迁协议,逾期拒绝腾退周转房的,由房屋拆迁主管部门责令限期退还,可并处五百元以上、五千元以下的罚款。

  第四十条 房屋拆迁主管部门执行罚款时,应出具省财政部门统一印制的收据,罚款全部上缴同级财政。

  第四十一条 违反本细则规定,应当给予治安管理处罚的,由公安机关依照《中华人民共和国治安管理处罚条例》的规定处罚;构成犯罪的,由司法机关依法追究刑事责任。

  第六章 附则

第四十二条 外商投资成片经营开发土地的拆迁问题另行规定。

  第四十三条 本细则由省城乡建设环境保护厅负责解释。

  第四十四条 本细则自发布之日起施行。

办法
第一条 公路是为全社会服务的基础设施。为加快公路建设,以满足社会经济发展和人民生活水平提高对公路交通日益增长的需要,决定设置车辆购置附加费,作为公路建设专用的一项资金来源,特制定本办法。
第二条 车辆购置附加费在全国范围内征收,每辆车只征一次。
第三条 凡购买或自行组装使用的车辆(不包括人力车、兽力车和自行车,下同),在购买时或投入使用之前必须缴纳车辆购置附加费。
第四条 车辆购置附加费以车辆的购买者或使用者(包括国家机关和军队)为义务缴费人(以下简称缴费人)。
第五条 车辆购置附加费的征收范围如下:
(一)国内生产和组装(包括各种形式的中外合资和外资企业生产和组装的,下同)并在国内销售和使用的大、小客车、通用型载货汽车、越野车、客货两用汽车、摩托车(二轮、三轮)、牵引车、半挂牵引车以及其它运输车(如厢式车、集装箱车、自卸汽车、液罐车、粉状粒状物散
装车、冷冻车、保温车、牲畜车、邮政车等)和挂车、半挂车、特种挂车等。
(二)国外进口的(新的和曾使用过的)前款所列车辆。
第六条 下列车辆免征车辆购置附加费:
(一)设有固定装置的非运输用车辆。
(二)外国驻华使领馆自用车辆,联合国所属驻华机构和国际金融组织自用车辆。
(三)其他经交通部、财政部批准免征购置附加费的车辆。
第七条 车辆购置附加费的征收管理工作由交通部门负责,并由本办法所列单位代征。
第八条 国内生产或组装的车辆,其车辆购置附加费由生产厂或组装厂代征,以车辆的实际销售价格为计费依据。组装自用的车辆向所在地交通部门缴纳车辆购置附加费,参照同类车辆的当地价格计费。国内生产和组装的车辆购置附加费费率均为百分之十。
第九条 国外进口的车辆,其车辆购置附加费由海关代征,以计算增值税后的计费组合价格(即到岸价格+关税+增值税)为计费依据,费率为百分之十五。
第十条 缴费人缴纳车辆购置附加费后,发给统一的缴费凭证。缴费凭证由交通部统一制定格式。
第十一条 缴费人缴纳车辆购置附加费取得缴费凭证后,才能向交通监理或公安车管部门申请车辆牌照。如交通监理或公安车管部门发现有漏缴情况,应责成缴费人向当地交通部门缴纳费款,并增收补办费。
第十二条 购车人购买免征车辆购置附加费的车辆,应向所在地交通部门申请,办理免征手续,取得免征凭证后,才能向交通监理或公安车管部门申请车辆牌照。
第十三条 车辆购置附加费的收入列为交通部专户存入中国工商银行,并由各地工商银行负责划转。
第十四条 对车辆购置附加费,免征国家能源交通建设基金。
第十五条 车辆购置附加费的全部收入作为国家公路发展基金的一项来源。基金的使用由交通部按照国家有关规定统一安排。
第十六条 各级交通部门统一管理、监督车辆购置附加费的征收、上缴。车辆购置附加费的代征单位应建立专门帐目,按期将征收的费款存入当地工商银行交通部车辆购置附加费专户,并向负责征收的交通部门填报有关报表。代征单位可以提取代征费款的千分之三,作为代征手续费。
第十七条 负责征收费款的交通部门有权检查代征单位的代征代缴情况,如发现有不按本办法办理的,应要求其立即改正;有漏征、滞缴费款情况时,应处以罚款。
第十八条 缴费人不按本办法缴纳费款的,除追缴费款外,并酌情处以应缴费款五倍以下的罚款。伪造凭证的,依法惩处。
第十九条 缴费人同征收部门在缴费问题上发生争议时,必须先按征收部门的决定缴费,然后向上一级交通部门、财政部门申请复议。
第二十条 对检举揭发漏缴车辆购置附加费和伪造凭证的单位或个人,应给予奖励。
第二十一条 本办法由交通部、财政部负责解释,并制定实施细则。
第二十二条 本办法自一九八五年五月一日起施行。

MEASURES FOR THE IMPOSITION OF SURCHARGES FOR PURCHASES OF MOTOR
VEHICLES
(Promulgated by the State Council on April 2, 1985)
Article 1
Highways are infrastructure to serve the whole society. To speed up the
construction of highways so as to meet the increasing demands for highways
owing to the socioeconomic development and the rising living standards of
the people, these Measures are formulated based on the decision to impose
surcharges for purchases of motor vehicles as a special source of funds
for the construction of highways.
Article 2
Surcharges for purchases of motor vehicles are imposed nationwide and each
vehicle purchased shall be surcharged only once.
Article 3
A surcharge must be paid for all purchased motor vehicles to be assembled
and used by the purchasers themselves (not including manpowered vehicles,
animal-drawn vehicles or bicycles) upon purchase or actual use.
Article 4
The purchasers or users (including State organs and armed forces) of the
vehicles are obliged to the surcharge (hereinafter referred to as payers).
Article 5
Surcharges shall apply to purchases of the following motor vehicles:
(1) Domestically manufactured or assembled vehicles for domestic sale and
use (including those manufactured and assembled by various forms of joint
ventures and foreign-capital enterprises). These include buses, mini-
buses, general-purpose freight vehicles, cross-country vehicles, passenger
vans, two-wheel and three-wheel motorcycles, tractor trucks. semi-tractor
trucks, other transport vehicles (including delivery vans, container,
trucks, tipper lorries, tankers, lorries for transporting powdered or
particulate cargoes in bulk, cold storage and heat preservation vans,
cattle vans, mail vehicles, etc.) as well as trailers, semi-trailers and
trailers for special usage.
(2) All imported (new ones and the second-hand) vehicles as listed in the
preceding paragraph.
Article 6
The following vehicles shall be exempt from surcharges:
(1) Vehicles with fixed installations for purposes other than
transportation.
(2) Vehicles used by foreign embassies and consulates, representative
offices of the UN organizations and international financial organizations
in China.
(3) Other vehicles exempt from surcharges as approved by the Ministry of
Communications and Ministry of Finance.
Article 7
The collection of the surcharge for purchases of motor vehicles shall be
administered by the communications departments and the surcharges shall be
collected on their behalf by the units listed in these Measures.
Article 8
The surcharge for the vehicles manufactured and assembled domestically
shall be collected by the producers or assemblers; the rate of the
surcharge shall be calculated on the basis of the actual sale price. The
surcharge for vehicles assembled and used by the purchaser shall be paid
at the local communications departments and the rate be calculated on the
basis of the local market price of similar vehicles. The rate of the
surcharge for domestically manufactured and assembled vehicles is 10 per
cent.
Article 9
The surcharge for imported vehicles shall be collected by the Customs. The
rate shall be 15 per cent based upon a combined price (i.e. C.I.F. +
duties + the value added tax.)
Article 10
The payers, upon surcharge payment, shall be issued "surcharge-paid"
certificates. The form of certificates shall be devised by the Ministry of
Communications.
Article 11
Only with "surcharge-paid" certificates can the payers apply for vehicle
licence plates to the communications superintendencies or vehicle control
departments of the public security organs, which shall, in cases of
evasion of payment, order the evaders to pay the surcharges at the local
communications departments, with an additional service charge.
Article 12
Purchasers of the vehicles that are exempt from the surcharge shall apply
to the local communications departments for exemption certificates before
registration with the local communications superintendencies or public
security organs for vehicle license plates.
Article 13
The incomes from the collection of surcharges for purchases of motor
vehicles shall be deposited with the China Industrial and Commercial Bank
in a special account of the Ministry of Communications and shall be
transferred to the account by the Bank's local branches.
Article 14
The surcharges for purchases of motor vehicles shall be exempt from the
State Fund for Energy and Transportation development.
Article 15
The entire income of surcharges for purchases of motor vehicles shall be a
source of funds for the country's highway development. The funds shall be
used under the unified arrangement of the Ministry of Communications
according to relevant regulations of the State.
Article 16
The collection and transfer of the surcharges are administered and
supervised in a unified way by communications departments at various
levels. The collecting units for surcharges for purchases of motor
vehicles shall establish special account books and deposit the money
collected in the special accounts of the Ministry of Communications for
surcharge for purchase of motor vehicles at the local industrial and
commercial branch banks. They shall also fill out relevant forms and
statements and submit them to the communications departments in charge of
collecting the surcharges. The collecting units are entitled to draw 0.3
per cent of the amount collected as service charge.
Article 17
The communications departments in charge of the surcharges have the right
to supervise the collecting units with respect to the conditions of the
collection and transfer. Immediate rectification shall be required for
any failure to act upon these Measures; and fines shall be imposed on
surcharge omissions or delayed transfers.
Article 18
Payers who fail to pay surcharges according to these Measures shall make
up the payment and, in addition, be imposed according to the
circumstances, a fine up to five times or less the amount due. Forgery of
certificates shall be punished according to law.
Article 19
In cases where disputes occur between the payers and the collecting
departments, the payers shall pay first as demanded and then apply to
higher communications departments or finance departments for
reconsideration.
Article 20
Individuals and units that expose or report on cases of surcharge evasion
or certificate forgery shall be awarded.
Article 21
The Ministry of Communications and the Ministry of Finance shall be
responsible for the interpretation of these Measures and the formulation
of the rules for the implementation thereof.
Article 22
These Measures shall go into effect on May 1, 1985.
